Homologation of Protection Mandates, Tutorships, Temporary Representation Measures and Expert Testimony
Clinique Vivago offers psychosocial assessment services required for the homologation of protection mandates, the institution of tutorships (guardianship), or temporary representation measures for incapacitated adults. Psychosocial Assessment for the Homologation of a Protection Mandate, Institution of Tutorship or Temporary Representation
Package A - Social Worker
Hourly Rate: $180
The psychosocial assessment examines the individual’s:

Mental health and cognitive function;
-
Functional and financial capacities;
-
Social network and available support systems;
-
Decision-making abilities and understanding of legal matters;
-
Vulnerabilities and potential risk factors.
The social worker’s evaluation offers a holistic understanding of the individual’s cognitive, emotional, and social well-being and is a necessary component of the assessment package.
Medical Doctor – Triangulated Assessment
To further strengthen the accuracy of our evaluation, we triangulate our findings with the individual’s treating physician. This ensures that our assessment aligns with the person’s medical history, cognitive health, and any relevant diagnoses.
1) The client or their legal representative must provide us with their physician’s contact information and, at the minimum, confirmation of an appointment scheduled with their physician for their portion of the evaluation before we can proceed with our assessments.
2) Once a formal legal request is received, we require written consent from the client (or their legal representative) to send reports to the notary handling their case. It is important that the individual subject to the evaluation is made aware of the reason for our assessments, including in circumstances where their ability to provide clear and informed consent is unclear.
The final report(s) will be sent to the notary only after full payment is received and with explicit client consent.
Example durations:

If additional time is required, it will be billed at $180 per hour for any professional involved (social worker, occupational therapist, or any additional consultation needed) with clear justification provided for the extra time.

Interdisciplinary Package - Involvement of an Occupational Therapist
Hourly Rate: $180
Social Work Assessment:
The psychosocial assessment examines the individual’s:

Vulnerabilities and potential risk factors.

Occupational Therapy Assessment
The OT conducts a detailed functional assessment that evaluates the individual’s ability to:
1) Care for themselves and maintain personal safety, including:

Self-feeding, washing, bathing, dressing;
-
Managing medications;
-
Identifying and responding to risks (e.g., fires, household dangers).
2) Protect themselves from harm, including:
-
Evaluating vulnerability to financial abuse, fraud, or undue influence;
-
Assessing their ability to recognize and mitigate risks related to self-neglect or unsafe living conditions.
3) Care for their environment, including:
-
Housekeeping, meal preparation, and maintaining a safe living space.
4) Manage their finances, including:
-
Understanding banking, budgeting, and financial transactions;
-
Recognizing financial risks or exploitation
It is important to note that a person may be deemed capable of managing their self-care but not their finances, or vice versa. It is also possible for an individual to be fully capable in both areas or to require varying levels of assistance. Our evaluation will provide a clear, evidence-based distinction between these capacities to guide decision-making.
